Safe Harbor Privacy Principles
In the course of serving its customers, NTT America (NTTA) acquires, stores and transmits customer contact information that may contain personal information. Personal information - such as the customer's name, address, telephone number, electronic mail address and credit card data - is provided to NTTA by its customers in order to establish service. Where NTTA collects personal information directly from the individuals, it will inform them about the purposes for which it collects and uses personal information about them, and the choices and means NTTA offers customers for limiting the use and disclosure of personal information.
NTTA may forward specific customer data including, personal information to necessary third party providers, but only in conjunction with providing contracted services. From time to time NTTA may provide customers information regarding their current or upcoming products via email, telephone calls or direct mailings. Customers may opt out of these marketing emails by clicking on the unsubscribe link at the bottom of marketing communications or by going to www.us.ntt.com/optout/hosting.
With respect to Human Resources, Notice will be provided in clear and conspicuous language when individuals are first asked to provide Personal or Sensitive Information to NTTA, or as soon as practical thereafter, and in any event before NTTA uses or discloses the Information for a purpose other than for which it was originally collected.
Individuals may opt out of having their personal information (a) disclosed to a third party that is not a permitted transferee (as defined below) (a "non-transferee third party") or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. Customer may opt out of receiving marketing information by clicking on the unsubscribe link at the bottom of marketing communications or by going to www.us.ntt.com/optout/hosting. Customers may not, however, opt out of receiving information from NTTA which is essential for maintaining or updating customers' accounts or system information.
With respect to Human Resources, NTTA will give individuals the opportunity to affirmatively or explicitly (opt out) consent to the disclosure of Sensitive Personal Information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. NTTA shall treat Sensitive Personal Information received from an individual the same as the individual would treat and identify it as Sensitive Personal Information.
Disclosures and Transfers
NTTA does not disclose an individual's personal information to third parties except when:
- NTTA has the individual's permission to make the disclosure;
- the disclosure is required by law or mandatory professional standards;
- the disclosure is reasonably related to the sale or other disposition of all or part of NTTA's business;
- the information in question is publicly available;
- the disclosure is reasonably necessary for the establishment of legal claims; or
- the disclosure is to another division of NTTA, to an affiliate of NTTA, or to persons or entities providing services on NTTA's or the individual's behalf (each a "permitted transferee"), consistent with the purpose for which the information was obtained, if the permitted transferee, with respect to the information in question (a) is subject to law providing at least the same level of privacy protection as the Safe Harbor Principles; (b) has agreed in writing to provide at least the same level of privacy protection as the Safe Harbor Principles; or (c) subscribes to the Safe Harbor Principles.
Permitted transfers of information include the transfer of data from one jurisdiction to another, including transfers to and from the United States of America.
With respect to Human Resources, prior to disclosing Personal information to a third party, NTTA shall notify the individual of such disclosure and allow the individual the choice (opt out) of such disclosure. NTTA shall ensure that any third party for which Personal Information may be disclosed subscribes to the Safe Harbor Principles or are subject to law providing the same level of privacy protection as is required by these Principles and agree in writing to provide an adequate level of privacy protection.
NTTA protects the confidentiality of its customers' personal contact and account information. To secure the information collected online, prevent unauthorized access, maintain data accuracy and ensure only appropriate use of information that is collected from customers, NTTA has implemented appropriate physical, electronic, and managerial procedures. Further, NTTA requires that employees keep customer information confidential. NTTA cautions its customers and website visitors that no medium of communication, including the Internet, is entirely secure.
NTTA has put in place appropriate physical, electronic and managerial procedures to safeguard and secure Human Resource Information from loss, misuse, unauthorized access or disclosure, alteration or destruction. Company cannot guarantee the security of information on or transmitted via the internet.
NTTA processes personal information only in ways compatible with the purpose for which it was collected or authorized by the individual. To the extent necessary for such purposes, NTTA takes reasonable steps to ensure that data is reliable for its intended use, accurate, complete, and current.
Authorized customers may access and modify their personal contact information via their on-line portal interface which can be found at https://us.portal.ntt.net.
With respect to Human Resources, NTTA shall allow an individual access to their Personal Information and allow the individual to correct, amend or delete inaccurate information, except where the burden or expense of providing access would be disproportionate to the risks to the privacy of the individual in the case in question or where the rights of persons other than the individual would be violated.
NTTA is committed to ensuring all customer personal information is handled in a manner consistent with the purpose for which the information was obtained. If a customer has inquiries or complaints about how their personal information is handled, please send an email to email@example.com. We will provide answers or begin investigations as necessary.
NTTA may amend this policy from time to time by posting a revised policy on this website, or a similar website that replaces this website. If NTTA amends the policy, the new policy will apply to personal information previously collected only insofar as the rights of the individuals affected are not reduced. So long as NTTA adheres to the Safe Harbor Principles, we will not amend our policy in a manner inconsistent with the Safe Harbor Principles.
